  17. DESCRIPTION: The United States will ensure that in
  18. considering applications for a grant
  19. of authority to transmit programming
  20. to foreign stations for retransmission
  21. into the United States under Section
  22. 325 of the Communications Act of 1934
  23. (the Act), the Federal Communications
  24. Commission (FCC) will not consider the
  25. nationality of the affected stations
  26. for the purpose of favoring a U.S.
  27. station that is competing with a
  28. Mexican station for affiliation with a
  29. U.S. programmer. Rather the FCC will
  30. apply the criteria for the grant of
  31. such permit in the same manner as
  32. would be applied to a domestic
  33. broadcast station application under
  34. Section 309 of the Act. 
  35.  
  36. In addition, the term of the Section
  37. 325 permit shall be extended from one
  38. year to five years in all situations
  39. where it can be assured that the
  40. retransmitting station is and will be
  41. in full compliance with applicable
  42. treaties. In assessing the public
  43. interest, convenience, and necessity
  44. required by the Act for the grant of
  45. authorization under Section 325, the
  46. primary criterion will be avoiding the
  47. creation or maintenance of electrical
  48. interference to U.S. broadcast
  49. stations that violates applicable
  50. treaty provisions. In evaluating this
  51. and any other criteria permitted under
  52. Section 309, the U.S. will ensure that
  53. the Section 325 process shall not be
  54. conducted in a manner that would
  55. constitute an unnecessary restriction
  56. on trade.

  76.          provide foreign legal consultancy services, and to establish
  77.          for that purpose, in Alaska, California, Connecticut, District of
  78.          Columbia, Florida, Georgia, Illinois, Michigan, New Jersey, 
  79.          New York, Ohio, Oregon, Texas, and Washington, or in any other
  80.          state that so permits by the date of entry into force of this
  81.              agreement.
